Deputy Attorney General Lisa Monaco recently gave a fiery speech announcing a set of Department of Justice policies aiming to encourage companies to quickly self-disclose misconduct and employ compensation clawback measures to deter bad actors. Monaco’s discussion was followed a day later by a similar speech by Assistant Attorney General Kenneth Polite, who emphasized the importance of strong compliance programs.

Ryan Patrick, a partner at law firm Haynes Boone and the former U.S. attorney for the Southern District of Texas, agreed with Himmel.
“I think the DOJ is frustrated,” he said. “I don’t think there are the white-collar enforcement numbers that this DOJ has promised.”
One reason why this may be occurring is because of the backlog from Covid-19, Patrick said.
